Terms of service

1. Definitions

“Seller” refers to Wallace Wallace.

“Buyer” refers to the customer purchasing goods from the Seller.

“Goods” means linen products, including but not limited to Tablecloths, Napkins, or other related textile items.

“Custom Order” means any product that is made to the Buyer’s specifications, including custom sizing, colours, embroidery, or any other alterations or personalisation requested by the Buyer.

2. General

By placing an order with the Seller, the Buyer agrees to be bound by these Terms and Conditions. These Terms supersede any prior agreements or communications, unless otherwise agreed in writing by the Seller. 

3. Orders

3.1 All orders are subject to acceptance by the Seller.
3.2 The Seller reserves the right to refuse or cancel an order at any time before dispatch.
3.3 Custom Orders must be confirmed in writing and accompanied by all required specifications and approvals.
 

4. Pricing and Payment

4.1 Prices are quoted in AUD and are inclusive of GST.
4.2 Full payment must be received prior to dispatch unless otherwise agreed in writing.
4.3 The Seller reserves the right to adjust prices at any time before acceptance of an order.

4.4 Custom Orders must be paid in full at the time of order.

 5. Lead Times and Delivery

5.1 Estimated delivery dates are provided in good faith but are not guaranteed.
5.2 The Seller is not liable for any delay caused by events beyond its reasonable control.
5.3 Risk in the Goods passes to the Buyer upon delivery to the Buyer’s nominated address or collection by the Buyer.

 6. Returns and Refunds

6.1 The Seller complies with all rights under the Australian Consumer Law (ACL) in relation to defective or misdescribed goods.
6.2 Returns will only be accepted where Goods are faulty, damaged, or incorrectly supplied.
6.3 The Buyer must notify the Seller in writing within 14 days of delivery if Goods are believed to be faulty or incorrect.
6.4 Returned Goods must be unused, unwashed, and in original packaging unless defective.

7. Custom Orders – Non-Refundable

7.1 All Custom Orders are final and non-refundable, except where required by law.
7.2 Once a Custom Order has been confirmed by the Buyer, no cancellations, changes, or refunds will be accepted.
7.3 The Buyer is responsible for ensuring all specifications, dimensions, colours, and details for Custom Orders are correct at the time of order.
7.4 The Seller will not be liable for errors resulting from incorrect information supplied by the Buyer.

8. Product Variations

Due to the nature of linen and textile manufacturing, slight variations in colour, texture, or weave may occur. Such variations are not considered defects and do not entitle the Buyer to a refund or replacement.

9. Limitation of Liability

Except as required by law, the Seller’s liability is limited to the repair, replacement, or refund of the purchase price of the Goods at the Seller’s discretion. The Seller is not liable for indirect or consequential loss.

10. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia, and the parties submit to the jurisdiction of its courts.
